The following is a TRUE STORY - an incident that EVERYONE who is involved with making bank transfers of money from ENGLAND or the UNITED KINGDOM to a bank in MALLORCA SHOULD READ CAREFULLY :

WARNING TO ALL CLIENTS OF NATIONAL WESTMINSTER BANKS - NAT WEST UK: PLEASE READ THIS:

BANK TRANSFER ABUSE CREATES A NIGHTMARE CHRISTMAS FOR UK COUPLE WANTING TO BUY LOVELY BEACH HOLIDAY APARTMENT IN MALLORCA:

SUBJECT: ABUSIVE, ILLEGAL, GREEDY and GROSS MISHANDLING OF PRIVATE FUNDS BY THE NATIONAL WESTMINSTER BANK, COLLEGE STREET, AMMANFORD Branch in ENGLAND:

FACTS: 1) On the 25th of October 2005, Mr. and Mrs. Terence Davies formalize an option contract to purchase a beautiful furnished sea view beach apartment in Torrenova Magalluf for 130,000 Euros.

2) After only TWO DAYS from Mr. Davie´s solicitation, NAT WEST AMMANSFORD BRANCH sends the deposit finds that arrive on the 4th of November, a transfer of 15,080 Euros arrive at the lawyer´s client account to complete the option contract deposit condition. The agreed date for full payment and signing of the deeds before the Spanish Notary Sr. Manuel Beltran, Club De Hielo building, 2nd floor, Son Caliu, Palma Nova, Calviá Mallorca Tel. 0034-971.135055 is made for the 20th of December 2006, at 10am. This is the deadline for payment in full and signing of the deeds in front of the notary. Failing to do this will, according to Standard Spanish law and practice, allow the owner of the apartment to keep the deposit paid as part payment for damages in not completing the contract as agreed.



3)On the 25th of November 2006, via email and telephone, Mr. Davies opens a joint account with the CAJA DE MADRID bank, with Mr. Thassilo Siglar handling the paperwork. (Avenida Pere Vaquer Ramis c/v Cas Jaboners, 07182 MAGALLUF (Baleares) Tels: 0034.971.134554 and 0034.971.135220. The CAJA DE MADRID one of the largest banks in Spain, in this case, with branch the office located in the area of Magalluf, Torrenova, Calviá.

National Westminster bank College Street Ammanford.

4) On the 6th of December Mr. and Mrs. Terrence Davies ordered their branch of the National Westminster Bank, COLLEGE STREET, AMMANFORD BRANCH UK., to swift transfer (IBAN) the sum of 131,000 Euros (90,000 Pounds Sterling), via the IBAN bank system to his bank account at the Caja De Madrid bank, Magalluf, Mallorca, Spain. The ASSISTANT DIRECTOR Mr. DELFTH JONES, Tel. 0044.8453020777, handles the transaction. On the transfer form it states CLEARLY the IBAN bank transfer account numbers, AND the address of the CAJA DE MADRID in Torrenova Magalluf, Balearic Islands SPAIN. Mr Davies paid 18 pounds sterling for the IBAN transfer, something NORMAL and almost exactly the same charge the Spanish Banks charge for similar amounts transferred overseas to European community nations. THEN the NAT WEST charge Mr. Davies a WHOPPING 100 POUNDS STERLING as an “Agent Bank” fee.

5) This 100 Pounds Sterling is merely an INVENTED CHARGE by the bank to enrich their coffers for absolutely NO reason or grounds. The SPANISH banks DO NOT charge this fee at all. I personally have made several IBAN transfers with nothing more than a 20 Euros fee (14.30 Pounds Sterling).

ON THE TRANSFER CONTRACT it STATES IN WRITING that the FUNDS WILL ARRIVE at the destination IN FOUR WORKING DAYS.

NATWEST BANK

6) On the 7th of December the NAT WEST bank calls Mrs. Davies for her PASSPORT NUMBER AND ADDRESS….something the bank ALREADY HAS ON FILE! This call is an OBVIOUS EXCUSE to hold on to THEIR MONEY one extra DAY! On the 7th of DECEMBER, The NAT WEST BANK of AMMANFORD sends Mr. and Mrs. DAVIES 131,000 EUROS TO NAPOLIS IN ITALY!!!

NAPLES ORION BANK

7) ON THE TRANSFER CONTRACT it STATES IN WRITING that the FUNDS WILL ARRIVE at the destination IN FOUR WORKING DAYS.

8) The rason given, when called, states Mr. DELFTH JONES is that “…...oh, this is NORMAL, we always transfer the money out to the bank that gives us the best interest, also we do not have a correspondent bank for the Caja de Madrid, so we send it to another bank who has.”

Napoli - Euro - UK - STERLING.

9) The NAPOLIS BANK is NOT a correspondent bank of the CAJA DE MADRID and some days later, sends it to some OBSCURE MADRID BANK who is also NOT a correspondent bank of the Caja De Madrid!

10) 19th of DECEMBER 2005: Mr. and Mrs. Davies ARRIVE in Mallorca, rent a car, book a hotel, expecting to sign and pay for the apartment they signed an option for.

11)AS OF THE 20th of DECEMBER, 2005, these funds HAVE NOT ARRIVED IN MR. DAVIES SPANISH CAJA DE MADRID ACCOUNT. Thassilo of the local branch in Magalluf called Madrid head office of the foreign transfer department, and in their banking system there is NO TRACE of the 131,000 Euros.

12) TEN WORKING DAYS HAS PASSED SINCE THE TRANSFER WAS INITIATED.

13) Mr. Davies calls the NAT WEST BANK for information as to WHERE IS HIS MONEY. They DO NOT KNOW, and offer to SEARCH FOR THE MONEY for a FEE of 25 POUNDS STERLING!! What a GREAT WAY TO ADD INSULT TO INJURY!
This is like giving a package to the POSTMAN, the package is not delivered on time, ITS LOST, and the POSTMAN CHARGES THE SENDER 25 pounds to FIND IT! This is ABSOLUTELY RIDICULOUS and INTOLERABLE if not ABUSIVE.

RESULTS:

One VERY ANGRY CHEATED and ABUSED CUSTOMER

a) Mr. DAVIES has LOST 15,080 Euros from the OPTION CONTRACT, he has paid over 1,089 Euros in EXPENSES to come to MALLORCA, PLUS losing time OFF from their JOBS in the UK (Woolworths), PLUS the GERMAN OWNER OF THE APARTMENT has flown in to Mallorca at her expense for the signing of the deeds which was IMPOSSIBLE as NO FUNDS were available. She is claiming 1,098 Euros in Costs as well as KEEPING THE DEPOST PAID as part payment for damages and breach of contract.

b)The Int. LAWYER for Mr. Davies is claiming 1,380 Euros in COSTS for the work carried out, translations, contracts and extra work with claims and problems caused by the total INCOMPETANCE and INCONSIDERATION of the NAT WEST BANK, AMMANFORD branch.

INJUSTICE AND ABUSE OF POWER:

i) Mr. Davies PAID 118 Pounds sterling for the 131,000 Euros to be sent to SPAIN. The ARROGANT AMMANSFORD NAT WEST BRANCH sends the money to NAPOLI in ITALY to make a commission/interest on PRIVATE MONEY OWNED BY MR. DAVIES and NOT THE BANK. Mr. Davies DID NOT GIVE PERMISSION TO THE BANK to send the money to ITALY and MUCH LESS to use HIS money to make the BANK more interest INCOME. Naturally, ALL the INTEREST made in this fiasco will go to NAT WEST and Mr. Davies WILL NOT RECEIVE ONE CENT of it!

ii) From THERE, supposedly the money is sent to some OBSCURE Spanish bank in MADRID who has still nothing to do with the Caja De Madrid bank where it should have gone in the first place.

CAJA DE MADRID THASSILO SIGLEAR.

iii) SR. THASSILO SIGLAR of the CAJA DE MADRID STATED TODAY, TUESDAY the 20th of DECEMBER, 2005, that they HAVE RECEIVED LARGE SUMS TRANSFERRED TO THEM FROM THE NAT WEST BANK IN LESS THAN 72 HOURS!!

iv) This MUST mean that NAT WEST DOES have some bank connection with the CAJA de MADRID BANK as this would not have happed. THEREFORE there is ABSOLUTELY NO EXCUSE OR REASON THAT THESE FUNDS HAD TO BE TRANSFERRED TO ITALY other than to BENEFIT the GREED of one very large UK BANK.

v) WHY was NAT WEST AMMANFORD BRANCH able to transfer in TWO DAYS 15,080 Euros to a SPANISH BANK IN MALLORCA, yet after 10 WORKING DAYS, unable to organise the arrival of 131,000 Euros?

vi) REASON: There is not much INTEREST to be EARNED via OTHER BANKS on only 15,080 Euros!

vii) Mr. Davies requests the bank to FIND WHERE HIS money is, the bank NAT WEST AMMANFORD BRANCH does not have a CLUE where it is, and has the GALL to demand that Mr. Davies PAYS 25 POUNDS STERLING for them to FIND IT!!

RECOMMENDATIONS AND ACTION:

1) Present a DENOUNCEMENT TO THE POLICE for gross and incompetant mis-use of PRIVATE FUNDS. The police and or the GOVERNMENT REGULATORY AGENCY responsible for controlling the ACTIONS OF UK BANKING should IMMEDIATELY CONDUCT A FULL AND THOROUGH INVESTIGATION.

2) Write a letter to the NAT WEST MANAGING DIRECTOR and CEO DEMANDING the EXPULSION of Mr. DELFTH JONES AND HIS SUPERIOR, the DIRECTOR of the NAT WEST AMMANFORD BRANCH.

3) Contract his UK LAWYER to CLAIM FOR ALL DAMAGES AND EXPENSES ABOVE MENTIONED PLUS ADDITIONAL DAMAGES for emotional STRESS and TENSION that he, his wife and family have suffered from this GRAVE DISAPPOINTMENT as a result of this ABUSE of TRUST, POWER and CONFIDENCE.

4) CONTACT THE PRESS, RADIO AND TV in WRITING with copies of documents and a full account of this despicable action to WARN ALL CLIENTS of NAT WEST to BE AWARE of these PERILS that they could ALSO SUFFER if they are involved in a similar situation. This incident MUST NOT happen again to anyone.

5) POST THIS LETTER ON THE INTERNET, in as MANY websites and BLOGS and TWITTERS possible.

BANKING INFORMATION ON MALLORCA:

There are a limited number of Banks in Palma de Mallorca that offer now up to 80% bank financing for the purchase of your property in Mallorca. This mostly applies to RESIDENTS and depends on the BANK VALUATION of the property and YOUR proveable income.

There is a SPECIAL GOVERNMENT ASSISTED bank finance plan for YOUNG PEOPLE starting up on their first job, or recently married. The Government will extend "soft" loans up to 300,000 Euros to young resident couples here on the island. For complete details, consult with one of the banks mentioned here below.

INTEREST RATES: They range from 2.75% to 4.35%

TIME LIMITS: Bank loans from local banks can be contracted from 5 years to a maximum of 30 years.

COSTS: Apart from the normal purchase costs of a properts which is 7% "transmisiones" or in the case of NEW properties it is 7% VAT(I.V.A.) plus the Notary and the Registry costs, and finally the plus value tax from the local town hall (where applicable), there are also costs for establishing a mortgage which is usually a 1% to 1.5% opening loan fee for the bank, plus the notary and registry and a small tax.

Your PROPERTY PURCHASE COSTS, including the Notary, Registry, VAT(IVA) or TRANSMISSION TAX, the PLUS VALUE TAX and 0.5% for the TAX OFFICE (HACIENDA) Documents, is approximately 9.8% of the declared value on the deeds. This does NOT include the costs for establishing a BANK LOAN MORTGAGE on the property which can be an extra 1.2% to 1.5% in costs such as 1% tax, notary, registry and processing.
PAYBACK:

The loans can be paid back usually at anytime before the time limit contracted for is out. In some cases, the banks charge a fee for closing the mortgage beforehand.

DEFERRED CAPITAL:

In the case that your monthly payments come at a difficult time for you, most banks will allow you to simply pay back the INTEREST each month for lets say 6 months, then resume normal payments of interest and capital. This can lower your monthly payments on the short term but on the long term you will be paying, in the end, more interest.
